Charter Quotation Terms & Conditions · Last updated: November 2026

These Terms & Conditions (the “Terms”) apply to every quotation (“Quote”), booking and service arranged by TORIAVIATION - GLOBAL PRIVATE JET SERVICES SRL, Strada Buzesti 75 – 77, Sector 1, Bucharest 011 013, Romania (“ToriAviation”), for the party requesting or booking the charter (the “Client”), and to the use of this website. By accepting a Quote, making any payment or proceeding with any flight, the Client agrees to these Terms. Where a Quote or written charter confirmation contains specific terms, those terms prevail; a subsequent Quote that revises a previous Quote replaces it in full, even if it keeps the same Quote number.

1. ToriAviation is a broker, not an operator

ToriAviation is an aircraft charter broker. ToriAviation does not own or operate aircraft, is not an air carrier and does not hold an Air Operator Certificate. Every flight is performed by an independent operator that holds the Air Operator Certificate and approvals required for that flight (the “Operator”).

The Operator has sole and exclusive operational control of the aircraft and the flight, and is solely responsible for the aircraft’s availability, airworthiness, maintenance, insurance, crew, scheduling, flight planning, safety and all operational decisions, including whether, when and how a flight operates, its routing, any delay, diversion, technical stop, substitution or cancellation, and the carriage or refusal of any passenger, baggage, pet or item. The pilot in command has final authority in all matters of safety. ToriAviation has no control over, and accepts no responsibility for, these matters.

The Operator and aircraft are identified to the Client in writing, or verbally, within a reasonable time after that information becomes available and before the first departure. Operational and other factors may require a change of aircraft and/or Operator, even where a specific aircraft, registration or Operator was named in the Quote; the Client will be informed of any such change.

2. Aircraft availability

All aircraft are subject to availability, which is determined solely by the Operator and can change at any time, before or after confirmation, until departure. The issue of a Quote does not guarantee aircraft availability. Aircraft, images and specifications shown on this website are indicative examples of aircraft types and do not represent a specific aircraft or an offer. The specific aircraft, its registration, Operator and photographs are confirmed with the Quote and charter confirmation. ToriAviation shall not be responsible for any damages, losses or costs, incidental, consequential or otherwise, if the quoted or confirmed aircraft becomes unavailable; in that event ToriAviation will use reasonable efforts to propose a suitable alternative.

3. Quotes and confirmation

  • A Quote is valid for twenty-four (24) hours from the time it is provided, unless stated otherwise, and may be revised or withdrawn at any time before confirmation.
  • A Quote may be aircraft-specific or based on an aircraft type. Should the aircraft or itinerary change for any reason, the Quote may change.
  • An itinerary is not confirmed until the Client receives written confirmation from ToriAviation following the Operator’s acceptance. Confirmation may be withheld for any reason. Acceptance of a Quote or payment alone does not confirm an itinerary or oblige ToriAviation or the Operator to provide any flight.
  • Proceeding with any flight, including on a different aircraft or a modified itinerary, or making payment, constitutes acceptance of the applicable Quote and of any modifications and associated costs, whether or not the Quote was signed.

4. Additional expenses

Unless expressly included, a Quote does not include additional expenses, for which the Client is solely responsible, including but not limited to: de-icing; additional catering, ground transport and special requests; additional crew or crew overnight costs; airport, handling, parking, landing, navigation, slot, permit and security charges not quoted; use of a non-preferred handling agent (FBO) at the Client’s request; delay charges where the Client causes a departure delay; changes of airport, routing or schedule at the Client’s request; and any taxes or charges arising from the itinerary or from changes to it. Catering and ground services arranged at the Client’s request through ToriAviation may carry a coordination surcharge of up to twenty-five percent (25%), stated in advance. In-flight connectivity (Wi-Fi) is never guaranteed, may carry additional charges, and its unavailability does not entitle the Client to any discount.

5. Payment

  • Payment in full is due on acceptance of the Quote and in any case no later than three (3) business days before the first departure, by bank transfer to the account stated on ToriAviation’s invoice, unless otherwise agreed in writing. For short-notice flights, payment is due immediately on confirmation.
  • If cleared funds are not received in time, ToriAviation may cancel the itinerary, in which case cancellation charges apply. Card payments, where accepted, may carry a surcharge stated in advance.
  • Additional expenses incurred during the trip are invoiced after the flight and are payable on receipt.
  • Any overpayment will be refunded on request, quoting the Quote number.
  • Our bank details never change by email. Always verify payment instructions by telephone on +351 918 618 628 before paying. ToriAviation is not responsible for payments made to any other account.

6. Itinerary changes

Itinerary changes are possible subject to aircraft and crew availability as determined by the Operator, and will require a new Quote. Changes and cancellations must be notified in writing to charter@toriaviation.com, never to crew members. Changes are not accepted until ToriAviation confirms them in writing.

7. Cancellation by the Client

A cancellation takes effect only when written notice from the Client, or a person previously authorised by the Client in writing, is received. Cancellation charges apply as stated in the Quote or charter confirmation and increase as departure approaches; more stringent charges may apply where set by the Operator, and these will be communicated to the Client. Re-scheduling of a flight by the Operator to a later time, or to or from an alternative airport, does not entitle the Client to a waiver of cancellation charges.

8. Departure times, peak days and no-shows

  • Departure times are fixed, with a window of sixty (60) minutes after the scheduled time for passengers running late. A longer window must be requested at booking and may incur additional charges.
  • On peak or high-demand days, requested departure times may be honoured within three (3) hours before or after the time requested.
  • If passengers do not present within sixty (60) minutes of the scheduled departure of any leg, the flight may be treated as a no-show: the full charter price remains payable, an additional charge of up to fifteen percent (15%) of the Quote total may apply, and all remaining legs may be cancelled without refund.

9. Delays, diversions and force majeure

Neither ToriAviation nor the Operator is liable for any delay, diversion, technical stop, re-routing, substitution or cancellation caused by weather, air traffic control, airport or airspace restrictions, technical or safety requirements, crew duty limitations, government action, strikes, public health measures or any other event beyond reasonable control. If a flight does not reach its destination for any such reason, the Client shall pay all charges for the completed portion of the itinerary.

10. Passengers, conduct, documents and pets

  • The Client is responsible for ensuring that every passenger holds valid passports, visas, health and other travel documents for each destination, and for any consequences of their absence.
  • Passengers must act safely, respectfully and lawfully, and follow all instructions of the crew. If the crew or Operator considers, in its sole discretion, that any passenger’s behaviour is unsafe, dangerous, illegal or inappropriate, the flight or remaining legs may be cancelled, and the Client remains liable for full payment and any resulting damages.
  • The Client is solely responsible for any damage to the aircraft, its interior or equipment caused by the Client or anyone travelling with the Client, including special cleaning and repair.
  • Baggage is limited by the aircraft’s capacity. Dangerous goods are prohibited except as permitted by law and approved by the Operator.
  • Pets are carried only with prior agreement and subject to the Operator’s and destination’s requirements. Cleaning fees apply if a pet soils the aircraft.
  • The Client must complete any passenger, health or security declarations required by the Operator or authorities truthfully and completely; omissions may lead to cancellation without refund and liability for resulting damages.

11. Limitation of liability and indemnity

Liability for death or injury of passengers, and for loss of, damage to or delay of passengers and baggage during carriage, rests with the Operator as the air carrier, in accordance with applicable law and international conventions, including the Montreal Convention where it applies, and the Operator’s insurance. ToriAviation makes no representation or warranty as to the Operator’s performance and is not liable for any act, omission or default of any Operator, handling agent, caterer or other third-party supplier.

To the fullest extent permitted by law, ToriAviation’s total liability in connection with any booking is limited to the amount of ToriAviation’s remuneration for that booking, and ToriAviation is not liable for any indirect, incidental or consequential loss, including loss of business, profit, opportunity or enjoyment. The Client shall indemnify ToriAviation against any claims, losses and costs arising from the Client’s or its passengers’ breach of these Terms, conduct, documentation or damage. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Confidentiality and compliance

We treat the Client’s identity, itineraries and arrangements as strictly confidential and share them only as necessary to perform the flight, as described in our Privacy & Data Policy. Non-disclosure agreements are available on request. ToriAviation may carry out identity and sanctions checks and may decline any booking that would breach applicable laws or sanctions. Where a third-party broker books on behalf of its own client, that broker is responsible for its client’s compliance and for any taxes applicable to its resale.

13. This website

Aircraft descriptions, images and specifications on this website are indicative of aircraft types, based on manufacturers’ published data, and do not constitute an offer or a representation of any specific aircraft. All content on this website is the property of ToriAviation or its licensors.

14. Governing law and arbitration

These Terms are governed by the laws of Romania. Any dispute, controversy or claim arising out of or in connection with them, including their breach, termination or validity, shall be finally resolved by arbitration under the Romanian arbitration law and applicable commercial arbitration rules, seated in Bucharest, Romania, before a panel of three arbitrators, unless the parties agree otherwise or mandatory law provides otherwise. The award shall be final and binding, and judgment on it may be entered by any court having jurisdiction. The parties understand that they would otherwise have the right to have their disputes decided by a court, and they choose instead to have all disputes resolved by arbitration.
